In that case, a cost-efficient amicable divorce with only one lawyer may be suitable for you. The lawyer represents only one spouse. The other spouse does not need separate legal representation and can consent to the divorce without having their own lawyer.
A personal hearing of both spouses before the competent family court (divorce hearing) will generally still take place.
Required Information and Documents:
Marriage certificate and any prenuptial or marital agreements
Nationality of both spouses
Current address of both spouses
Address of the last joint habitual residence
Birth certificates of any joint minor children
Date of separation
Current monthly net income of both spouses
The documents can be sent by post or as scanned copies by email.
Procedure and Processing Time:
After receipt of the complete documents, you will receive a draft divorce application. Any questions can be clarified by phone or email.
Fees:
From €975.41 (including VAT)
The fees are determined by the procedural value, which is based, among other factors, on the combined net income of both spouses multiplied by three. After a personal consultation, a more precise estimate of the expected costs can be provided.
In certain cases, an application for legal aid (Verfahrenskostenhilfe) may be possible. If granted, only low instalments or no fees may need to be paid initially.
